DATES  By submitting the non-refundable retainer you lock in this promotional price and acknowledge that the service is reserved for you. However, a specific date is not yet set. Monika will keep you informed on open dates as they became available. Once your chosen date is set and confirmed, you will be asked to put down the remaining half of your balance (4 weeks prior to the date) to ‘lock in’ the date. Session has to be consumed by December 2022.

FEES The price agreed upon between Client & Photographer shall be in amount of the package value which shall be full payment for the Photographer’s services as set forth in this agreement.

Submitting this non-refundable retainer is considered signing this agreement, and as a reservation for service. The remaining balance must be paid 4 weeks before the session takes place.

MODEL RELEASE & COPYRIGHT Any and all original digital images forever remain the property of the Photographer. Monika Broz have the permission to use reproductions of any of the photographs for samples, displays, internet pages, advertising, exhibitions, contests, and other purposes.

LIMITS OF LIABILITY If the Photographer cannot perform this contract due to an extreme cause beyond the control of the parties, Monika Broz will reschedule or return monies paid by the Client but shall have no further liability with respect to the contract. This limitation in liability shall also apply in the event that photographic materials are damaged in processing, lost through camera/computer malfunction or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

PERMITS/ LOCATIONS/ GARMENTS/ OTHER FEES Client will be responsible for any admission or permit fees (if required) on location shoots, unless otherwise discussed. Monika Broz will not be held responsible for damage to garments in environmental events.

RESCHEDULING/ POSTPONEMENT/ CANCELLATION If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible for both parties. Once your chosen date is set and confirmed, the session can only be rescheduled due to the bad weather, or a very serious reason (such as illness) on client’s part, otherwise the fee of $250 for rescheduling will apply.

RESHOOTS In the extremely unlikely event that Client is completely dissatisfied with the final results based solely on personal preference, Photographer will reshoot at a 25% discount from the original session fee. Client will then be able to order images from the second portrait session only. In the unlikely event that the finished product from a portrait session is unusable due to technical problems, (camera failure or exposure problems), Photographer will reshoot at no additional charge.

PHOTOGRAPHIC MATERIALS & IMAGE GALLERY All images shall be the exclusive property of the Photographer. The Photographer shall make gallery proofs available through an online gallery proofing website or through an in-person ordering session. Image gallery shall be available to the Client within 2-3 weeks of the session. This online proofing gallery shall remain live for 120 days from delivery. If the Client requests to extend the time or reopen the online proofing gallery, a $25 un-archival fee shall apply.
